Agreement to Receive Electronic Communications

For your reference, these are the terms and conditions that govern your election (if and to the extent you have made such an election, and such election is available) to receive electronic delivery of your mortgage loan account related disclosures, notices, and statements (“Communications”).  Election of such is made when accessing your account(s) within MyIBMCLoan.com by selecting the delivery preference option of ‘Email’.

If you have multiple loan accounts, it is important to note that your delivery preferences must be setup separately for each loan account.

The election to have Communications delivered via U.S. Mail, by selecting the delivery preference option of ‘Mail’, is not governed by these terms and conditions.

General

To be sent certain documents electronically, rather than through U.S. Mail, you must review and agree to the terms and conditions identified in this Agreement to Receive Electronic Communications (“Agreement”). You should read through this entire Agreement carefully before consenting. When selecting the delivery preference option of ‘Email’ and consenting to this Agreement, you permit Iowa Bankers Mortgage Corporation (“IBMC”) to provide applicable Communications to you in electronic form, instead of providing such Communications in paper form through U.S. Mail.  If you do not elect to receive electronic delivery, you will continue to be sent applicable Communications via U.S. Mail.

By accessing this Agreement, you are demonstrating your ability to access electronic communications in this format prior to consent.

Your consent is effective until:

  • further notice by IBMC;
  • withdrawal by you, as noted in the “How to Withdraw Consent and Requesting Paper Copies” section, or;
  • revocation by IBMC because of non-delivery or if service is used in any way that is contrary to law or that breaches this Agreement.

Definitions

The terms “we,” “us” and “IBMC” refer to Iowa Bankers Mortgage Corporation, with whom you have your mortgage loan account(s).

The terms “you” and “your” refer to you the mortgage loan borrower, whether singular or plural, who: (1) is an individual that is a borrower on a mortgage loan account at IBMC or (2) is an individual authorized by a borrower to effect transactions on their loan account.

Scope of Communications to be provided in Electronic Form

By consenting to this Agreement, you agree that we may provide you with Communications in electronic form and that we may discontinue sending you paper versions of these Communications, unless you withdraw your consent as provided in this Agreement. Your consent to receive electronic communications will apply to any Communications you have selected the delivery preference option of ‘Email’ for in MyIBMCLoan.com, which may include the following, as applicable to your mortgage loan account(s):

  • Periodic Billing Statements; including monthly or other periodic billing statements
  • Annual Statements; including 1098 mortgage interest statements (tax forms), and annual private mortgage insurance (PMI) disclosures

Method of Providing Communications to You in Electronic Form

IBMC will notify you by email when a document eligible for electronic delivery is available.  It is your responsibility to ensure that IBMC has your current and valid email address and to notify IBMC if you change your email address. IBMC shall not be liable for any third-party fees, legal liability, or any other issues or liabilities arising from notices sent to an invalid or inactive email address that you have provided.

Please contact us as noted in the “Communications between the Bank and You” section to update your email address, report any problem with electronic delivery of any document type, receive information about how to request a paper copy of any electronic document, or if you have any questions about our electronic delivery offering.

How to Withdraw Consent and Requesting Paper Copies

You may withdraw your consent to receive Communications electronically at any time. To withdraw your consent while accessing your mortgage loan account in MyIBMCLoan.com, you must select the ‘Mail’ option for the applicable document(s) within the Account Management screen under Delivery Preferences.  Alternatively, you may notify IBMC in person, via telephone, or via U.S. Mail of your decision to withdraw consent. Our telephone number and postal mail address are listed below in the section entitled “Communications between IBMC and You”.

There is no cost associated with withdrawing your consent and you will not be required to pay a fee for receiving paper copies of the applicable Communications you elect to receive by U.S. Mail.  When accessing your mortgage loan account in MyIBMCLoan.com, you can also print a paper copy of any Communication we provide to you electronically.  Additionally, you may request that we mail you a paper copy of any Communication by notifying us in person, via telephone, or via U.S. Mail.  Our telephone number and postal mail address are listed below in the section entitled “Communications between IBMC and You”.

Security

You agree to protect the confidentiality of your mortgage loan account and loan account number, and your user ID and password. You understand that your user ID and password by itself or together with information related to your mortgage loan account may allow unauthorized access to your account. By consenting to this Agreement, you understand that data transferred via the Internet is not encrypted and that IBMC cannot and does not warrant that any data transfers utilizing the Internet, or email transmitted to and from us, are not accessible by others.

Your logon password is confidential information that should be known only by you. IBMC will not, for any reason, ask for your logon password. If anyone contacts you and requests this information, contact us immediately. You are responsible for keeping your logon password confidential.

Hardware and Software Requirements

To access, download, and print Communications, you need to have a personal computer or mobile device with Internet and email access. You must also have a PDF reader such as Adobe Acrobat Reader. To download a free copy of Adobe Acrobat Reader, please go to http://www.adobe.com.

If you do not have the ability to access and retain PDF documents, do not consent to electronic delivery.

If the hardware or software requirements change, and that change would create a material risk that you would not be able to access or retain electronic Communications, the changes will be described in an updated version of this Agreement which will be made available to you either by email or when you next access and change your delivery preferences within MyIBMCLoan.com.  You may then elect to consent to or withdraw from such updated Agreement and the revised requirements specified therein.

Retaining Copies

You may print this Agreement for your records.  Communications sent electronically are available to view, print, and/or download within MyIBMCLoan.com for as long as you continue to maintain a valid user ID and password to access the website and have open mortgage loan accounts with IBMC.  We encourage you to print or download for your records a copy of any Communications that are important to you that you wish to retain for a longer period of time.
